Affidavits and notaries
An affidavit is a written statement you sign on oath; a notary attests it. Notary fees are fixed by the Notaries Rules and the schedule should be displayed at the office.
What to do
- First ask whether an affidavit is really needed: many government forms now accept a self-attested copy.
- Have the statement written clearly and truthfully (name, father’s/husband’s name, address, and what you declare); a false affidavit is an offence.
- Get it typed on stamp paper or e-stamp of the prescribed value; sign in front of the notary and show an identity document.
- The notary stamps, signs and enters it in the register; take a receipt and check the fee against the schedule.
- Affidavits filed in court are often sworn before an Oath Commissioner; ask the advocate which is required.
What to bring
- Identity document (Aadhaar, voter card, passport)
- The papers of the matter the affidavit is for (form, notice)
- Passport-size photo (many offices ask for one)
