Road accident: compensation claim (MACT)

For death or injury in a road accident, a compensation claim lies under section 166 of the Motor Vehicles Act before the Motor Accident Claims Tribunal (MACT). File within six months of the accident. For hit-and-run cases there is a separate government compensation scheme.

What to do

  1. Get the injured to hospital first (108); keep every treatment record and bill.
  2. Lodge an FIR; note the vehicle number, driver and insurance details. The police send a detailed accident report (DAR) to the tribunal.
  3. File the claim petition at the MACT (District Court, Rudrapur): where the accident happened, where the claimant lives, or where the opposite party lives.
  4. Inform the insurer; compensation is usually paid by the insurance company. The tribunal can also grant interim relief.
  5. If the vehicle is unknown (hit and run), apply at district level under the hit-and-run compensation scheme; the DLSA helps with this.

  • FIR, police investigation report, charge sheet
  • Medical reports, discharge slip, bills; in a death case, post-mortem report and death certificate
  • Proof of income and age of the injured or deceased, list of dependants
  • The vehicle’s RC, driving licence and insurance (if available)
