Domestic violence and maintenance
Under the Protection of Women from Domestic Violence Act 2005 a woman can get protection, residence and monetary orders. A wife, children and parents can claim maintenance in the Family Court. Women are entitled to free legal aid.
What to do
- In immediate danger, 112. Call the women helpline 1090 or 181; through 181 the One Stop Centre (Sakhi) gives shelter, medical, police and legal help in one place.
- Through the district Protection Officer or the DLSA, a domestic incident report and application are filed before the Magistrate; there is no fee.
- The Magistrate can pass protection orders, a residence order for the shared household, interim custody of children and monthly monetary relief.
- A separate maintenance application (wife, children, parents) can be made in the Family Court, Rudrapur; interim maintenance can also be sought.
- An FIR can also be lodged for dowry harassment or assault; both remedies can run together.
What to bring
- Identity document, proof of marriage (card, photos, certificate), children’s birth certificates
- Medical reports of injuries, photos, threatening messages, names of witnesses
- Whatever proof of the husband’s or family’s income is available (salary slip, property details)
