Tenancy and property: the basics
A written agreement, rent receipts and tenant verification with the police prevent most disputes. Before buying land, check the khatauni and the registered deed.
What to do
- Tenancy: make a written agreement stating rent, deposit, period, utilities and the notice for vacating; both sides keep a copy.
- A lease of a year or longer must be registered at the Sub-Registrar office; that is why 11-month agreements are common.
- Landlords should verify tenants on the Uttarakhand Police citizen portal; keep rent receipts or bank transfer records.
- In a dispute, send a written notice first, then approach a Lok Adalat or the civil court; forcing a tenant out or locking the premises is unlawful.
- When buying land: check the khatauni on Bhulekh, get the earlier deeds and encumbrances (loans, litigation) searched at the Sub-Registrar office, and after registration apply for mutation (dakhil-kharij) at the tehsil.
